Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Open Career website (https:// opencareer.co.uk) and any related services (collectively, the “Platform”). By accessing or using Open Career, you agree to be bound by these terms. If you do not agree with these Terms, you should not use our platform.

In these terms, “Open Career”, “we”, “us”, or “our” refers to the operators of the Open Career platform (currently not registered as a separate legal entity). “You” or “User” refers to any individual or entity using our platform, including candidates, employers, and any other visitors.

We may modify these terms from time to time by posting updated terms on the platform. We will indicate the date of the latest revision at the top of this page. Changes will become effective immediately upon posting. It is your responsibility to review these terms periodically. Your continued use of the platform after changes are posted constitutes acceptance of the updated terms. 

1. Account Registration and Security

1.1 Eligibility:

You must be at least 16 years old to create an account or use the platform. By registering, you represent that you meet this age requirement and, if under 18, that you have the consent of a parent or guardian. The platform is intended for use in the United Kingdom; users accessing it from other jurisdictions are responsible for compliance with local laws.

1.2 Account Creation:

To access certain features of Open Career, such as applying for jobs or posting listings, you will need to create an account as a candidate or an employer. You agree to provide truthful, accurate, and complete information during registration and to keep your account information updated. You may have the option to register or log in using third-party services like Google or Facebook. If you choose to use a social login, you authorize us to obtain necessary information (such as your name and email address) from that third-party account. Use of third-party login options is also subject to those third parties’ terms and privacy policies.

1.3 Account Security:

You are responsible for maintaining the confidentiality of your account credentials (username and password or social login credentials) and for all activities that occur under your account. Do not share your password with others. If you suspect any unauthorized use of your account or any security breach, you must promptly notify us. We are not liable for any loss or damage arising from your failure to protect your account information.

1.4 Profile Information:

When creating a profile, candidates may upload a CV and provide details like work experience, education, and skills. Employers may create a company profile with information about their organization. All information you submit should be accurate and not misleading. You must not impersonate any person or entity or misrepresent your affiliation with anyone else.

2. Acceptable Use of the Platform

We strive to maintain a respectful and lawful environment on Open Career. By using the platform, you agree to the following rules of acceptable use. You must not:

2.1 Violate any Laws or Regulations:

Do not use Open Career to post or transmit any content that violates applicable laws or regulations. This includes, but is not limited to, laws regarding employment, data protection, intellectual property, and non-discrimination. Job postings must comply with UK employment laws and regulations (for example, postings must not unlawfully discriminate based on age, gender, race, religion, disability, etc.).

2.2 Provide False or Misleading Information:

Do not post jobs or profiles that are false, fraudulent, misleading, or involve scam tactics. Employers should only post legitimate job opportunities with clear and honest descriptions. Candidates should provide truthful qualifications and not apply on behalf of someone else.

2.3 Infringe Others’ Rights:

Do not upload or share content that infringes any third party’s intellectual property rights, privacy rights, or other rights. You must own or have permission to use any content (such as logos, text, or images) that you include in your job posts or profile.

2.4 Harass or Abuse Others:

Do not harass, bully, or send unwanted communications to other users. Maintain professional and respectful interactions. Employers should use candidate information solely for recruitment purposes related to their posted jobs and not to send unrelated promotions or spam. Candidates should similarly refrain from spamming employers or engaging in inappropriate communication.

2.5 Interfere with the Platform’s Operation:

Do not attempt to disrupt or damage our platform. Prohibited activities include introducing viruses or malicious code, attempting to hack or gain unauthorized access to our systems or other users’ accounts, scraping data or crawling the site in an automated way not permitted by our robots.txt, or performing any action that imposes an unreasonable load on our infrastructure.

2.6 Bypass or Violate Security Measures:

Do not try to circumvent security features, probe or test the vulnerability of our platform, or authenticate as other users. Any attempt to compromise the security of Open Career is strictly forbidden.

2.7 Use for Unintended Purposes:

Do not use the platform for any purposes other than connecting candidates with job opportunities. For example, do not use the candidate database to build your own mailing list, and do not use job postings to advertise services unrelated to actual job openings.

We reserve the right to suspend or terminate accounts that violate these acceptable use rules or any other provision of these terms (see Section 6 on Termination). We may also remove or modify any content that violates these rules or is otherwise objectionable, without prior notice.

3. User Content and Intellectual Property

3.1 Your Content:

Open Career allows users to create and share content, including job listings, company descriptions, candidate profiles, CVs, and messages (collectively, “User Content”). By posting or submitting any user content on our platform, you retain ownership of your content. However, you grant Open Career a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your content as necessary to operate the platform (for example, to display your job post to candidates or to show your profile to potential employers). This license ends when you delete the content from our systems, except to the extent it has been shared with others via the platform (for instance, a CV submitted to an employer) or is retained in backup archives for a limited period.

3.2 Content Standards:

You are responsible for ensuring that your user content is lawful, accurate, and appropriate. Content should be relevant to job seeking or hiring. We do not allow content that is offensive, obscene, defamatory, or threatening or that promotes illegal activities. We also do not permit job ads that require applicants to pay fees or purchase products (which may indicate a scam or pyramid scheme) or any postings that violate ethical standards of recruiting.

3.3 No Responsibility for User Content:

While we may monitor or moderate content on the platform, Open Career is not responsible for user content posted by others. We do not endorse any opinions expressed by users. If you encounter content that violates these terms or seems suspicious, please report it to us.

3.4 Open Career Intellectual Property:

The Platform and its original content, features, and functionality (excluding User Content) are owned by Open Career and/or its licensors and are protected by copyright, trademark, and other intellectual property laws. This includes our site design, logos, graphics, and any software or code used in the platform. You may not copy, distribute, modify, or create derivative works from our proprietary content without our express permission. You are welcome to share links to job postings or profiles, but scraping or bulk downloading content without authorization is prohibited.

3.5 Feedback:

If you provide us with suggestions, ideas, or feedback about the platform, you agree that we may use and implement such feedback without any obligation to compensate you. Any improvements or modifications to the service based on your feedback remain our property.

4. Third-Party Services and Links

4.1 Social Login and Integrations:

Open Career may integrate with third-party services to enhance the user experience. For example, we offer login via Google or Facebook, and we use analytics and advertising services from Google and Meta (Facebook/Instagram). When you use these
integrations, you may be providing data to those third parties as well as to Open Career. Your use of Google services (such as Google sign-in or features of Google Analytics on our site) is subject to Google’s terms of service and privacy policy. Similarly, using Facebook Login or being subject to the Meta Pixel (Facebook ads tracking on our site) is subject to Facebook/Meta’s terms and policies. We do not control how third-party services operate, and we are not responsible for any acts or omissions of these third parties. 

4.2 External Links:

Our platform may contain links to third-party websites or resources, such as company career pages, external articles, or payment processing via Stripe. These links are provided for convenience only. Open Career does not endorse and is not responsible for the content, products, or services on third-party sites. If you access a third-party website through our platform, you do so at your own risk. Different terms and privacy policies may apply to your use of those sites.

4.3 Third-Party Payments:

In the future, Open Career may offer premium features or services that require payment (for example, employers paying for featured job posts or subscription packages). Payments on our Platform will be handled by a secure third-party payment processor (such as Stripe). If you make a payment, you might be directed to Stripe or another processor’s site or interface. Any financial information you provide (like credit card details) will be processed and stored by that third-party, not by Open Career. We do not receive or store full payment card details, though we may receive limited information (e.g., confirmation of payment, your name or email, and an indication that a payment was made). Third-party payment processing is subject to the processor’s terms and privacy policy. We will provide further details in our payment-related terms if and when paid services become available.

4.4 No Agency Relationship:

Using Open Career does not create any agency, partnership, or joint venture between users and Open Career or between candidates and employers via Open Career. We are simply a venue and service provider; all arrangements for employment or hiring are strictly between the candidate and the employer. Open Career is not liable for any issues arising from interactions or agreements between users outside the platform.

5. Disclaimers and Limitation of Liability

5.1 Service “As Is”:

Open Career is provided on an “as is” and “as available” basis. While we strive to maintain a reliable and secure platform, we make no warranty that the service will be uninterrupted, error-free, or free of harmful components. We cannot guarantee that job listings will result in successful employment or that candidate applications will lead to job offers. Users accept that the outcomes of using our platform are largely dependent on their own efforts and the actions of other users.

5.2 No Warranty:

To the fullest extent permitted by law, Open Career disclaims all warranties, express or implied, in connection with the platform and your use of it. This includes any warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. For example, we do not warrant the accuracy or reliability of any user-provided information (like job descriptions or CVs). You should exercise caution and common sense when evaluating potential employers or candidates.

5.3 Limitation of Liability:

To the extent permitted by applicable law, Open Career and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of (or inability to access or use) the Platform; (b) any conduct or content of any third party on the Platform, including unlawful or offensive conduct of other users; (c) unauthorized access to or alteration of your transmissions or content; or (d) any matter beyond our reasonable control.

5.4 Cap on Liability:

In no event will our total liability to you for all claims arising out of or relating to your use of the platform exceed the amount (if any) that you have paid to us in the last six (6) months for any paid services or £100, whichever is greater. If you have paid no fees, our liability is limited to £100. We do not exclude or limit our liability for matters that cannot be excluded under law, such as death or personal injury caused by our negligence, or for fraudulent misrepresentation. 

5.5 User Disputes:

Any transactions, communications, or dealings between users (for example, between a candidate and an employer) are solely between those users. Open Career is not a party to any contracts or agreements that users may enter into (such as an employment contract). We do not mediate or resolve disputes between users, though we may, at our discretion, try to facilitate an amicable solution or take action on the platform if a user violates our terms.

5.6 Indemnification:

You agree to indemnify and hold harmless Open Career and its operators, employees, and agents from any claim or demand made by any third party due to or arising out of your breach of these Terms, your use of the Platform, your violation of any law or regulation, or your infringement of any rights of another. This means you will reimburse us for any losses, liabilities, costs, or expenses (including reasonable legal fees) that we suffer because you violated these Terms or misused the Platform.

6. Termination of Service

We reserve the right to suspend or terminate your account or access to Open Career at any time, with or without notice, if you violate these terms or if we determine, in our sole discretion, that it is in our best interest or the best interest of our user community to do so. For example, if an employer posts fraudulent jobs or a candidate is found misusing data, we may disable their accounts.

You have the right to discontinue using our platform at any time. Candidates and employers can also delete their accounts through their account settings or by contacting us. Upon deletion of an account, we will remove or anonymize personal data associated with that account in accordance with our Privacy Policy and applicable law. However, portions of your user content that were shared with others (such as CVs or messages already sent) may still be retained by those parties or remain visible if they were copied or stored by them.

Termination of an account will not waive or affect any rights or liabilities that may have arisen under these terms prior to the date of termination. Sections of these Terms that by their nature should survive termination (such as intellectual property rights, disclaimers, liability limitations, and indemnity) will continue to apply even after an account is closed or these Terms are otherwise terminated.

7. General Provisions

7.1 Governing Law:

These Terms of Use and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. By using the Platform, you agree that any legal matters will be dealt with in the courts of England (or another jurisdiction, if required by applicable consumer laws).

7.2 Entire Agreement:

These Terms (along with our Privacy Policy and any other policies or guidelines we provide) constitute the entire agreement between you and Open Career regarding your use of the Platform, and supersede any prior agreements or understandings, whether written or oral, relating to such subject matter

7.3 Severability:

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remainder of the Terms will remain in full force and effect.

7.4 No Waiver:

Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Open Career.

7.5 Assignment:

You may not assign or transfer any of your rights or obligations under these terms without our prior written consent. We may assign or transfer our rights and obligations to a third party in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law or otherwise.
